INTELLECTUAL PROPERTYINFRINGEMENT POLICY

This intellectual property infringement policy (“IP Policy”) must be read along with the Terms and Conditions, Privacy Policy and Editorial Policy of Quikdu.

The domain name www.quikdu.com, together with the Quikdu mobile applications for Android and iOS, is owned and operated by QUIKDU SOLUTIONS PRIVATE LIMITED, a company incorporated under the Companies Act, 2013 (hereinafter referred to as “Quikdu”, “Company”, “we”, “us” or “our”). The domain name, website and mobile applications are collectively referred to as the “Platform”. This IP Policy explains how Quikdu respects and responds to claims concerning intellectual property rights, including trademarks, copyrights and other applicable intellectual property rights.

Quikdu respects the intellectual property rights of individuals, businesses, manufacturers, brand owners, content creators and other rights holders. Quikdu does not knowingly permit the Platform to be used for the sale, distribution, display, publication or other commercial use of content or products that unlawfully infringe the intellectual property rights of others. At the same time, Quikdu may lawfully display third-party brand names, trademarks, logos, product names, product photographs and other identifying information for the purpose of accurately identifying, describing, marketing or offering genuine third-party products for sale, where such use is permitted under applicable law.

The Platform may display the names, trademarks, logos, product names and other brand identifiers of third-party manufacturers and brand owners. Unless expressly stated otherwise, Quikdu does not claim ownership of third-party trademarks. Third-party trademarks remain the property of their respective owners. The display of a third-party brand, trademark or logo does not by itself mean that Quikdu is affiliated with, sponsored by, endorsed by, or an authorized representative, distributor or partner of that brand. Quikdu may use third-party trademarks to identify and describe the corresponding genuine products offered for sale on the Platform, subject to applicable law. Quikdu does not represent that it owns, controls or operates any third-party brand. Where a specific brand relationship or authorization exists, Quikdu may expressly identify that relationship on the relevant Platform page.

Quikdu may offer genuine branded products that have been lawfully acquired through its suppliers, distributors, manufacturers or other legitimate commercial channels. The use of a third-party trademark for the purpose of identifying genuine goods does not, by itself, mean that Quikdu claims ownership of that trademark or represents itself as the trademark proprietor. Quikdu may retain appropriate purchase invoices, supplier information, product information, batch details and other records relating to products offered through the Platform. Where required by applicable law or where reasonably necessary to investigate a legitimate complaint, Quikdu may review such records to verify the source or authenticity of products.

Quikdu respects copyrights in photographs, product descriptions, artwork, graphics, videos, advertisements, written content, software and other creative works. Where third-party content is used on the Platform, Quikdu expects such content to be created or owned by Quikdu, provided or licensed by the relevant manufacturer, supplier, distributor or rights holder, used with appropriate permission, or otherwise used in a manner permitted under applicable law. A claim that a product image, description, photograph, graphic or other content infringes copyright should identify the specific work allegedly infringed and provide sufficient information to allow Quikdu to investigate the claim.

If You believe that Your intellectual property rights are being infringed by material appearing on the Platform, You may submit a written complaint (“Claim”) to info@quikdu.com. To help us investigate the matter, Your Claim should include the URL(s) or specific location(s) where the allegedly infringing material appears, a clear identification or description of the allegedly infringing material, identification of the intellectual property right allegedly infringed including the trademark registration number, copyright information or other relevant details where available, evidence or information reasonably demonstrating Your ownership or authorization to act on behalf of the intellectual property rights holder, Your full name, organization name if applicable, address, telephone number and email address, a description explaining why You believe the material infringes Your rights, a statement confirming that the information provided in the Claim is accurate to the best of Your knowledge and that You are authorized to submit the Claim, and a good-faith statement that You believe the disputed use is not authorized by the intellectual property owner, its agent or applicable law.

Upon receiving a sufficiently detailed Claim, Quikdu may review the relevant material and request additional information or documentation where reasonably necessary. Depending on the circumstances, Quikdu may contact the relevant seller, supplier, content provider or other concerned party; request evidence regarding product authenticity, ownership or authorization; temporarily restrict or remove disputed content; request modification of disputed content; suspend or restrict access to specific material or listings; restore material where the complaint is not substantiated; or take any other action reasonably considered appropriate under applicable law.

Where appropriate, a person whose material has been restricted or removed may be given an opportunity to provide relevant information, documentation or evidence concerning the disputed material. If the available information indicates that the material may lawfully be used, Quikdu may restore or continue displaying the material, subject to applicable law and any court order or direction from a competent authority. Nothing in this section limits Quikdu’s right to take precautionary action while a dispute is being reviewed.

Quikdu may decline to act on Claims that are materially incomplete, unsupported, misleading, abusive or submitted in bad faith. Where appropriate, Quikdu may request additional evidence before taking action. Nothing in this section prevents a genuine rights holder from submitting a properly supported Claim at a later time.

Nothing in this IP Policy is intended to grant any person a licence or permission to use Quikdu’s intellectual property, grant Quikdu ownership of any third-party intellectual property, restrict any rights or remedies available to a rights holder under applicable law, or waive any rights, defences, exceptions or limitations available to Quikdu under applicable law. This IP Policy should not be interpreted as creating rights beyond those available under applicable law.

Quikdu may cooperate with courts, governmental authorities, law-enforcement agencies or other competent authorities where required by applicable law or legal process. Quikdu may also preserve or disclose relevant information where reasonably necessary to comply with legal obligations or protect its legal rights.

Quikdu may update this IP Policy from time to time to reflect changes in its business, Platform, applicable law or operational practices. The updated version will be published on the Platform with the revised “Last Updated” date.
